NOTICE TO ALL APPLICANTS AND EMPLOYEES

In accordance with 20 CFR 655, the Code of Federal Regulations pertaining to the Department of Labor (DOL) Employment and Training Administration (ETA),

Notice is hereby made to all applicants and employees of the University of Kansas Medical Center (KUMC) that the institution has the intent of hiring one or more non-immigrant employees under the US Citizenship and Immigration Service (USCIS) classification of H-1B Specialty Worker.

This page contains links to DOL Forms ETA 9035E, electronic Labor Certification Application (LCA), that have been filed with the ETA for the purpose of hiring H-1B non-immigrant specialty workers at KUMC. Each LCA contains information regarding the occupational classification being filled, the wages offered, the period of employment, and the location of employment. For a field-by-field explanation of the contents of ETA 9035E, please refer to the cover pages ETA 9035CP.

Each LCA shall remain electronically accessible via this site for a minimum of 10 business days. During such time, the position shall remain open to U.S. workers as defined by federal regulations. At the close of the specified posting, if no minimally qualified U.S. worker has been found, the position may be filled with a non-immigrant employee.

Complaints alledging misrepresentation of material facts in the Labor Condition Application and/or failure to comply with the terms of the Labor Condition Application may be filed with any office of the Wage and Hour Division of the United States Department of Labor.

As per federal regulations, the Human Resources department maintains information about actual compensation. Payroll records are retained for a minimum of three years from the date of record creation. Copies of Prevailing Wage information are contained in public files in the Office of International Programs, where copies of relevant documents are retained for a period of one year beyond the last date on which a non-immigrant was employed under the LCA, or the date of expiration or withdrawal, whichever occurs first. Copies of all LCA forms filed by KUMC are available for public examination at the US Department of Labor, 200 Constitution Avenue, NW, Room N-4456, Washington, D.C. 20210.
